What is Arbitration?

Arbitration enables you to settle your legal dispute outside of court. Instead of going to trial, an experienced legal professional, typically an attorney or a judge, will listen to the facts of the dispute and make a ruling that will resolve the issue.

Arbitration proceedings can either be binding or non-binding. Rulings made in binding arbitration cases usually will not be appealable. Non-binding arbitration generally occurs when the arbitration proceeding is ordered by the courts. These cases are generally appealable. While arbitration is most common in labor, construction, and securities regulation disputes, it has recently become increasingly popular in other commercial litigation disputes as well.

The Arbitration Process

A neutral third party, the arbitrator, will be selected to preside over the case. All parties involved in the dispute must agree with the selection of the arbitrator. The arbitrator can either be a single person or a panel of legal professionals.

The arbitrator will lead negotiations and propose potential resolutions to your dispute. Arbitration continues until an agreement is reached by all parties. The decision of the arbitrator will be enforced by both federal and state courts.
