The Commonwealth of Pennsylvania has established three tiers of DUI infractions:
The penalties become more severe with each increasing DUI level. Minors, drivers of commercial vehicles, school bus drivers, and drivers involved in an auto accident injuring another or causing property damage may face stiffer penalties depending on the circumstances. If you refuse a breath, urine, or blood test, you may be charged with the penalties for the highest BAC level and face an additional one year license suspension.
The Commonwealth of Pennsylvania has established the following penalties for individuals convicted of a first offense DUI:
General Impairment:
High BAC:
Highest BAC:
After your license has been suspended for two months, you may apply for an occupational limited license. This license would only be valid for driving to and from work. For each subsequent conviction after your first DUI, the severity of your penalties will increase substantially.
The Accelerated Rehabilitative Disposition (ARD) Program offers first time DUI offenders an opportunity to earn a clean record. The ARD Program can shorten your potential driver's license suspension and enable you to avoid any mandatory jail time that you may face. As part of the program, you will be required to attend DUI education courses and drug and alcohol treatment if necessary. You will also need to perform community service and abide by standard conditions of probation supervision.
The ARD Program is only available to you once in a ten year period, and the District Attorney has the final say on whether or not you will be offered the program. Once you successfully complete the program, your charges will be dismissed and your record will be expunged.
